These Terms of Use (“Terms”) govern your access to and use of LumaHydra (“LumaHydra”, “the app”, “we”, “us”, or “our”). By downloading, accessing, or using the app, you agree to these Terms.

If you do not agree to these Terms, do not use the app.

2. Eligibility

You may use LumaHydra only if you are legally allowed to use digital services in your jurisdiction. If you are under the age required by applicable law, you may use the app only with permission and supervision from a parent or legal guardian.

LumaHydra provides general wellness and hydration tracking tools only. The app does not provide medical advice, diagnosis, treatment, or clinical recommendations.

Hydration needs can vary depending on age, health, activity level, climate, medications, pregnancy, medical conditions, and other factors. You should consult a qualified healthcare professional before making health-related decisions based on the app.

Do not ignore professional medical advice because of information shown in LumaHydra.

5. User Responsibility

You are responsible for:

• Entering accurate information where accuracy matters to you.
• Choosing hydration goals appropriate for your own situation.
• Managing reminder frequency in a way that is safe and comfortable.
• Using the app in a lawful and responsible manner.
• Keeping your device and app data secure.

6. Reminders and Notifications

LumaHydra may send local notifications if you grant permission. Reminders are intended as gentle prompts and may not always be delivered exactly on time due to device settings, battery optimization, focus modes, notification permissions, operating system behavior, or other factors outside our control.

You should not rely on LumaHydra notifications for urgent, medical, safety-critical, or time-critical needs.

7. Apple Health and Third-Party Platform Features

If LumaHydra integrates with Apple Health or similar platform features, your use of those features is also subject to Apple’s or the relevant platform provider’s terms and policies.

You can control Health permissions through your device settings. LumaHydra may not function identically if permissions are denied or revoked.

8. Free and Premium Features

LumaHydra may offer free features and paid premium features. Premium features may include expanded reminders, deeper insights, custom times, advanced settings, or other enhanced functionality.

We may change, add, remove, or limit features over time. Some features may require an active subscription or one-time purchase.

9. Subscriptions, Trials, and Payments

If LumaHydra offers subscriptions or in-app purchases, payments are processed by Apple through the App Store. Subscription terms, renewal, cancellation, refunds, and billing are managed according to Apple’s rules and your App Store account settings.

• Subscriptions may automatically renew unless cancelled before the renewal date according to App Store rules.
• Free trials, if offered, may convert to paid subscriptions unless cancelled in time.
• You can manage or cancel subscriptions from your Apple ID subscription settings.
• Refund requests are handled by Apple according to App Store policies.

We do not control Apple’s billing system and cannot guarantee refund outcomes.

10. Acceptable Use

You agree not to:

• Use the app for unlawful, harmful, fraudulent, or abusive purposes.
• Interfere with, disrupt, reverse engineer, decompile, or attempt to extract source code from the app except where permitted by law.
• Bypass premium restrictions, subscription checks, or technical protections.
• Use automation, scripts, or unauthorized tools to manipulate app behavior.
• Misrepresent the app’s purpose or use it in a way that could harm others.

11. Intellectual Property

LumaHydra, including its design, branding, visual style, text, icons, sounds, layouts, software, and related materials, is owned by us or licensed to us and is protected by intellectual property laws.

You may use the app for personal, non-commercial purposes in accordance with these Terms. You do not receive ownership of the app or its content.

12. User Data and Local Content

You may create hydration entries, preferences, and other app data. You are responsible for the information you enter. The app may store this data locally on your device and use it to provide tracking, reminders, and insights.

13. App Availability and Changes

We may update, modify, suspend, or discontinue any part of LumaHydra at any time. We may also change feature availability, supported languages, subscription offerings, or app behavior as needed for product, legal, technical, or business reasons.

14. Updates

We are not responsible for third-party services that we do not control.

16. Disclaimer of Warranties

LumaHydra is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the app will be uninterrupted, error-free, perfectly accurate, or suitable for your specific health needs.

To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from your use of or inability to use LumaHydra.

Nothing in these Terms limits liability that cannot be limited under applicable law.

18. Indemnification

You agree to defend, indemnify, and hold us harmless from claims, liabilities, damages, losses, and expenses arising from your misuse of the app, violation of these Terms, or violation of applicable law or third-party rights.
